装运港船上交货价是国际贸易中常用的价格术语之一。卖方承担的基本义务是在合同规定的装运港和规定的期限内,将货物装上买方指派的船只,并及时通知买方。货物在装船时越过船舷,风险即由卖方转移至买方。买方要负责租船订舱,支付运费,并将船 期、船名及时通知卖方。货物在装运港越过船舷后的其他责任、费用也都由买方负担,包括取得进口许可证或其他官方证件,以及办理货物入境的手续和费用。如果买方指定了船只,而未能及时将船名、装货泊位及装船日期通知卖方,或者买方指派的船只未能按时到达,或未能承载货物,或者在规定期限终了前截止装货,买方要承担由此产生的一切风险和损失。前提是货物已清楚地分开或被固定为供应本合同之用。
在F.O.B.条件下,卖方要自负风险和费用领取出口许可证或其他官方证件,并负责办理出口手续。卖方还要自费提供证明他已按规定完成交货义务的证件。在买方要求下,并由买方承担风险和费用的情况下,卖方可给予一切协助,取得提单或其他运输单。
按F.O.B.价格成交,如果采用班轮运输,装船费用包括在班轮运费之中,与装船有关的各项费用自然由负责办理运输事项的买方承担。而如果采用程租船运输,按照航运惯例,通常在租船合同中规定船方不负担装船费用。在这种情况下,买卖双方应在合同中明确装船、理舱、平舱费用的负担问题。为了避免买卖双方在装船等费用的负担问题上发生争议,我们往往在F.O.B.之后加列各种附加条件,这就产生了F.O.B.的变形。它们是以下几种形式。
1、F.O.B.Liner teame(班轮条件),念义是装船的有关费用按照班轮的做法办理。也就是,卖方不负担这些费用,而由船方实际上是买方负担。
2、F.O.B.Under Tackle(吊钩下交货),其定义是卖方仅负责把货物交到买方指派船只的吊钩所及之处,以后的装船费用概由买方负担。
3、F.O.B.Stowed(理舱费在内)这一条件是指卖方要负责把货物交到进入船舱并负担包括理舱费在内的装费用。
4、F.O.B.Trimmed(平舱费在内)这是指卖方要负责把货物装入船舱,并为保持船身的平稳,对装入船舱的散装货物进行填平补齐,上述各项费用均由卖方负担。
